Charles Keefe vs. Various Defendants
Defense verdict (12-0) on behalf of product manufacturer represented by Jenkins & Martin (J&M) in a living peritoneal mesothelioma case. The jury returned a verdict in favor of the client represented by J&M based on plaintiff’s failure to prove negligence or liability. Paul and Suzanne Verret vs. Various Defendants
Defense verdict (11-1) for product manufacturer represented by J&M in two living mesothelioma cases brought by a brother and sister, both in their mid-50s. The jury returned a verdict in favor of the client represented by J&M based on plaintiff’s failure to prove negligence or liability. Plaintiffs were represented by the law firm of Richardson, Patrick, Westbrook & Brickman and Tarrant County. Judge Ken Curry presided.

Harris Lacey vs. Various Defendants
Defense verdict (5-1) on behalf of product manufacturer represented by J&M in a mesothelioma case. The jury returned a verdict in favor of the client represented by J&M based on plaintiff’s failure to prove liability. Allegations of alter-ego and single business enterprise were defeated by J&M counsel. Plaintiff was represented by the law firm of Waters & Kraus and Dallas County. Judge John Peyton presided.

Kelvin Sandel vs. Various Defendants
Verdict (12-0) on behalf of a 49-year-old career carpenter, living mesothelioma case. The jury found negligence in a duty to protect customers but fault allocation diminished J&M client's liability to less than 1/10 of settlement demand. Plaintiff was represented by the law firm of Waters & Kraus and Tarrant County. Judge Ken Curry presided.

Joseph Baer vs. Various Defendants
Firm’s client resolved claims against it between the second and third days of jury deliberations. Other defendants settled after the mistrial was declared. This was a living lung cancer case. Evidence supported numerous responsible third parties for which the jurors had to consider. Plaintiff was represented by the law firm of Waters & Kraus and Travis County. Judge Lora Livingston presided.

John Melon vs. Various Defendants
Defense verdict (10-2) on behalf of product manufacturer represented by J&M in a mesothelioma case. The jury returned a verdict in favor of the client represented by J&M based on plaintiff’s failure to prove negligence or liability. Plaintiff, a career carpenter, was represented by the law firm of Brent Coon & Associates and El Paso County. Judge Javier Alvarez presided.

Donald Rosen vs. Various Defendants
Mistrial declared after a day and a half of deliberations on behalf of product manufacturer represented by J&M in a living mesothelioma case.

Donald Halpain vs. Various Defendants
Defense verdict (10-2) on sole issue of whether the statute of limitations was tolled by the “Discovery Rule” until a time preceding two years before suit was filed. J&M represented a product manufacturer in this asbestosis case. The jury returned a verdict in favor of the client represented by J&M based on plaintiff’s failure to prove that his work related injury was not barred by limitations. Plaintiff was represented by the law firm of Cappolino, Dodd & Krebs and Falls County. Judge Robert Stem presided.

Katie Franklin vs. Amy Slack – Verdict for Plaintiff in motor vehicle accident case. There was minor damage to the cars and the Plaintiff complained of soft tissue injuries. The jury awarded a fraction of the Plaintiff’s medical expenses and a fraction of what had been offered prior to trial. Plaintiff was represented by attorney Tom Moses and Jefferson County Judge Gary Sanderson presided.

Carl Len Moore, Jr. vs. April Dawn Haynes, et al – Defense verdict in a multi-vehicle accident on Interstate 10 in Beaumont, Texas. The jury returned a verdict in favor of the client represented by J&M based on Plaintiff’s failure to prove negligence or causation for the accident. Plaintiff was represented by the law firm of Weller, Green, Toups & Terrell and Jefferson County Judge Milton Gunn Shuffield presided.

Motions for Summary Judgment

Glen Blundell v. Various Defendants - Benzene exposure, product liability case. Lawyers at J&M filed a novel Sophisticated User, Learned Intermediary Motion for Summary Judgment which was argued before the court. The Judge took the motion under advisement and J&M was successful in securing a favorable settlement pending the Judge’s ruling on the motion.

Tony Hollister v. Various Defendants - In this Benzene exposure premises liability claim, J&M attorneys were successful in obtaining summary judgment for our client.

Phillip Smith, et al v. Various Defendants - Benzene-exposure, product liability claim. Lawyers at J&M filed a Motion for Summary Judgment based upon General Causation. The motion included extensive review of relevant Epidemiological Studies of downstream petroleum distribution workers. J&M was successful in securing a favorable settlement prior to the hearing on the Motion for Summary Judgment.

Melanie Mouchon v. Various Defendants – Premises Liability claim. Lawyers at J&M were successful in obtaining summary judgment for our client based upon ownership and control issues in this automobile-related wrongful death action.

Kenneth Muckleroy, et al v. Various Defendants – Asbestos Exposure premises liability claim. Lawyers at J&M were successful in obtaining summary judgment for our client based upon control issues related to the work of independent contractors.

Rosemary Smith, personal representative of Dorman Smith, deceased, vs. Various Defendants - J & M secured a summary judgment on claims against its client arising from alleged asbestos exposures resulting in terminal malignant mesothelioma. The decedent was a career construction worker with years of drywall finishing. J & M represented a drywall joint cement manufacturer.
